Project Overview

SPM was engaged to assess whether Clariant’s Lara facility required an EPA development and operating licence under the Environment Protection Act 2017 (Vic) and Environment Protection Regulations 2021 (Vic).

The site’s historical licence had been surrendered due to low emissions, and Clariant sought confirmation that its operations remained exempt under the current regulatory framework.

The Challenge

The project required a robust assessment of whether the facility met exemption criteria under EPA Determination S305, including:

  • Air emissions thresholds
  • Classification as a prescribed activity (G01 – Chemical Works)
  • Application of exemptions within Victoria’s modernised framework
  • Addressing regulatory uncertainty following initial EPA advice
